THE immediate past Minister of Education for State, Chukwuemeka Nwajiuba and a group, Incorporated Trustees of Rights for All International have filed a suit before a federal High court in Abuja, seeking the disqualification of the APC Presidential Candidate Bola Ahmed Tinubu.
In place Bola Tinubu, Chukwuemeka Nwajiuba wants the honourable court to declare him as the APC flagbearer for the 2023 presidential elections.
The suit is also seeking the cancellation of the votes of the PDP’s candidate Alhaji Atiku Abubakar.
The defendants in the case are APC, PDP, Bola Ahmed Tinubu, Atiku Abubakar, the INEC and Attorney General of the Federation.

Clariform reports Nwajiuba who was involved in settling the ASUU and FG industrial dispute purchased the APC nomination form of 100 million Naira to participate in the party presidential primary.
However, he failed to participate in the primary election for unknown reason. He also did not officially step down from the race, as many other aspirants did at the floor of the venue.
The former Minister is now complaining about what he refers to unfair practice surrounding the conduct of the APC primaries and have attached a video evidence of vote buying to the suit.
The Issues to be determined:
Nwajiuba is praying the court to determine whether the presidential primary of the party, APC contravened Article 11(A), 12(1) and 13(1) of the APC constitution.
The suit also seeks to determine if the PDP compiled with sections 33(1) and 5(c) of the Party.
In addition, to be determined in the suit is whether the court can nullify the primaries of the two parties relying on sections 6 (6) (A) (B) (C) and 15 (5) of the 1999 constitution.
Nwajiuba also wants the court to determine if the corrupt vote buying by the two candidates is not a enough to disqualify them from further participation in the general election come 2023
